unless the new Court can get through its work each session so much

hardship will be caused to litigants that it ought not to be Exitad

created; secondly, that it cannot deal effectively with urgent appeals.

These are two of the weightiest of my criticisms, and in view of the

undoubted fact to which I have already alluded that both Your Excel-

-lency and the Secretary of State are desirous of creating an effi-

-cient and not a non-efficient Court, I suggest that instructions

should be obtained at the earliest date possible to sanction the

opinion of the profession being asked upon them.

In connection with the question of time, I have

specially to draw Your Excellency's attention to the fact that in

Mr. Langley's letter of 11th. March, 1909, one of the reasons given fx:

for not proceeding further with the scheme is that "in view of the fact that the appeal sessions at Hongkong are described by the legal

officials of the Colony are likely to be of considerable duration,

instead of lasting for the fortnight which it was originally hoped

would suffice".

this Etix opinion of the legal officials is snared by the pro- -fession. In this connection I must again point out that if the scheme had been submitted to me or to the profession before it had been approved at home this fact would have been made clear to the Secretary of State.

With reference to paragraph 7 of the letter under reply which specially relates to the absence of any reference of the scheme to me before its approval, I fear that the facts connected with its introduction have escaped Your Excellency's memory.

The solitary reference to the idea that a new Appeal Court might be formed by the introduction of the Shanghai Judge was an allusion to the possibility of such a scheme being thought of in Your Excellency's long letter dealing with my recommendations for a third Judge, dated 14th. April. But I had heard nothing that the scheme was even contemplated until Your Excellency's letter of 16th. September, 1908, (beyond a vague rumour a few days previously) inform- -ing me that arrangements were being made to put it in force and a
